Il TAR Lombardia dichiara illegittime norme urbanistiche limitative per l’insediamento di strutture commerciali
Pubblichiamo una recente pronuncia con la quale il TAR Lombardia ha ritenuto che le norme di “liberalizzazione” del settore commerciale “impongono al giudice chiamato a sindacare la legittimità degli atti di pianificazione urbanistica che dispongono limiti o restrizioni all’insediamento di nuove attività economiche in determinati ambiti territoriali, l’obbligo di effettuare un riscontro molto più penetrante di quello che si riteneva essere consentito in passato; e ciò per verificare, attraverso un’analisi degli atti preparatori e delle concrete circostanze di fatto che a tali atti fanno da sfondo, se effettivamente i divieti imposti possano ritenersi correlati e proporzionati a effettive esigenze di tutela dell’ambiente urbano o afferenti all’ordinato assetto del territorio sotto il profilo della viabilità, della necessaria dotazione di standard o di altre opere pubbliche, dovendosi, in caso contrario, reputare che le limitazioni in parola non siano riconducibili a motivi imperativi di interesse generale e siano, perciò, illegittime “.
Nel caso in esame sono stati ritenuti illegittimi gli atti con il quale il Comune aveva previsto il divieto di insediamento di medie strutture di vendita di superficie superiore a 600 mq. in una determinata zona del territorio comunale poiché a seguito dell’istruttoria disposta in corso di giudizio non erano emersi elementi che ricollegassero tale divieto “ad esigenze di ordine ambientale o urbanistico ” (TAR Lombardia, Milano, 10 ottobre 2013 n. 2271 ).
